TERMS AND CONDITIONS:

FEE AGREEMENT / NON JOINT VENTURE RATE

 

This AGREEMENT is entered into by RODEO REAL ESTATE, MORTGAGE & INVESTMENTS, BROKER, Charles A. Sant Angelo and by INVESTOR(s)____________________________________________________________ of __________________________, CALIFORNIA.


1. Compensation
The terms of this AGREEMENT are as follows. For locating, researching, providing information and using its expertise in evaluating properties to be purchased ALL CASH at a TRUSTEE SALE, the INVESTOR(S) AGREES to compensate Rodeo Real Estate, Mortgage & Investments, BROKER, using one of the following PLANS.

PLAN 1. - 2.5% to 4.5% Commission Range

a. 1% of the Acquisition Price (paid at time of Acquisition).
b. Investor AGREES to sign the standard CA Exclusive Authorization Right to Sell Contract with Rodeo Real Estate, Mortgage & Investments
for the re-selling of the acquired property for a 1.5% commission due at Close of Escrow
c. If an 'outside' Broker's client buys the property, Investor would pay 2.5% to the outside Broker and 1% to Rodeo Real Estate, Mortgage & Investments. Otherwise total commission is 1.5% to SELL.

PLAN 2 - 3% to 5% Commission Range

a. No commission fee due at Acquisition.
b. Investor AGREES to sign the standard CA Exclusive Authorization Right to Sell Contract with Rodeo Real Estate, Mortgage & Investments for the purposes of reselling the acquired property for a 3% commission due at C.O.E. (If an outside Broker's client buys the property, then TOTAL Commission to be paid by INVESTOR is 5% that would be split 2.5% to Rodeo Real Estate Mortgage & Investments and 2.5% to outside Broker. (If Rodeo Real Estate is the sole Broker in the transaction, then total commission at C.O.E. is to be 3%.)

PLAN 3 - 4% COMMISSION

a. 4% commission fee due at Acquisition.
b. Investor is FREE to re-market the acquired Property in whatever manner he/she deems.

 


2. PLAN SELECTION

a. Investor can use either plan he/she chooses on each of his/her Acquisitions.
b. Investor AGREES that if 1% commission is not paid at time of Acquisition to
Rodeo Real Estate, Mortgage & Investments, then PLAN 2 Automatically will
be deemed the Plan in effect.

 

3. ATTORNEY FEES

It is MUTUALLY AGREED that any dispute that arises out of this AGREEMENT shall be resolved through binding ARBITRATION with the prevailing party
Entitled to any attorney and arbitration cost and fees .


4. CONFIDENTIAL INFORMATION

Investor AGREES and ACKNOWLEDGES that ANY and ALL property information given to him/her by Rodeo Real Estate, Mortgage & Investments, (BROKER)shall be construed as work performed for compensation. Therefore, should the investor purchase any property that was brought to his/her/their attention by Rodeo Real Estate, Mortgage & Investments, (BROKER), and fails to compensate said BROKER using fone of the 3 plans stated above, for that purchase, then, it is absolutely AGREED to that Rodeo Real Estate, Mortgage & Investments, BROKER, is entitled to be compensated 6% of the purchase price due within 72 hours of ACQUISITION.

5. Property Identification

INVESTOR is to FAX a list of all properties he/she/they already have knowledge about so that if one or more of these properties appears on a list received by
Rodeo Real Estate, Mortgage & Investments, those property(s) will be excluded from the terms of this Agreement. Said list must be faxed prior to your receiving and/or viewing a list of properties from Rodeo Real Estate, Mortgage & Investments. We will acknowledge receipt of your fax as 'confirmation' that it was received. Without this confirmation it shall be expressly deemed that no list was received by us. It is the INVESTOR's responsibility to ensure he/she/they are in receipt of our confirmation.

 

 


6. ENTIRE AGREEMENT

Set forth above is the entire AGREEMENT. Any changes shall be mutually agreed to and be in writing.
